Terms of Service

These terms are an agreement between you and PHXGrowth ("PHXGrowth", "we") and govern your use of phxgrowth.com and any services you engage us for. Individual engagements are additionally governed by the written scope or plan you accept — where the two conflict, the written engagement wins.

PHXGrowth provides managed paid-advertising services, creative production, and custom business automation. Managed plans are billed monthly with a performance component as listed on the pricing page at the time you subscribe; one-time services are quoted in writing before work begins.

All plans are month to month unless your written engagement says otherwise. You can cancel ahead of any renewal; work already performed and the current billing period remain payable.

Advertising outcomes depend on your offer, margins, market and platforms we don't control. Projections on this site — including the growth calculator and any emailed plan — are illustrative models, not promises. We commit to honest reporting measured against your real profit; we do not guarantee revenue, ROAS, lead volume or any specific business result, and nothing on this site should be read as that guarantee.

When you connect ad accounts, storefronts or accounting tools, you grant us permission to operate them for the agreed scope — budgets, campaigns, creative, reporting. Your accounts, audiences, customer data and business records remain yours at all times; ending an engagement never touches them.

The systems we engineer — websites, automations, workflows, creative systems, dashboards and the PHXGrowth engine they run on — are and remain PHXGrowth's intellectual property. They are licensed to your business for the duration of your engagement. When the engagement ends, the license ends with it: access is revoked and PHXGrowth-hosted systems are decommissioned.

Accurate information about your business, timely access to the accounts in scope, and lawful products and offers. We may decline or terminate work on offers that are illegal, deceptive, or that violate the advertising platforms' policies — their rules bind both of us.

Retainers are billed at the start of each monthly period; performance components are billed as specified in your plan. Invoices are payable on receipt unless your engagement says otherwise. If payment fails and isn't cured within 14 days, we may pause work until the account is current.

We treat your business data — spend, margins, customer information, strategy — as confidential, use it only to deliver the services, and expect the same care from you with any non-public material we share.

To the maximum extent the law allows, our total liability for any claim arising out of the services is capped at the fees you paid us in the three months before the event giving rise to the claim, and neither of us is liable to the other for indirect, incidental or consequential damages — including lost profits or ad spend outcomes. Nothing in these terms limits liability that can't be limited by law.

Either side may end an engagement ahead of any monthly renewal. On termination, our access to your accounts ends, your license to PHXGrowth-built systems ends and those systems are decommissioned from our infrastructure, and we delete engagement data on request per our Privacy Policy. Anything that lives in your own accounts — audiences, customer lists, campaign history, business records — stays exactly where it is: with you.

These terms are governed by the laws of the jurisdiction where PHXGrowth is organized, without regard to conflict-of-law rules.

We may update these terms; the effective date above moves when we do, and material changes are announced to active clients by email. Questions, notices, disputes: admin@phxgrowth.com.
